This page states the conditions under which Edgewood Consulting Group (the firm) lets you use this website. It is arranged as a list of headings, each followed by what the heading means in practice. Anyone visiting the site is taken to have accepted these conditions. The firm's privacy document, on a separate page, is to be read with them.
- Reach of these conditions
-
They apply to your access to, and use of, this website and everything served under its domain. Visiting the site is acceptance. If they are not acceptable to you, the remedy is not to use the site. The firm's postal address is 1719 State Route 10, Suite 226, Parsippany, NJ 07054.
- Purpose of the site
-
The site gives a general description of the firm's consulting and analytics services. It makes no offer that can be accepted, quotes no price and commits the firm to nothing. Every client engagement rests exclusively on an engagement letter or agreement signed by the firm and the client; should the site and such a document disagree, the signed document prevails.
- Email from the firm
-
The firm may write to professionals whose responsibilities relate to its services. A recipient who wants no more can answer the message and say so, however briefly, and that ends it. The privacy document explains how recipients are chosen, what is recorded about them and what rights they have.
- Illustrations
-
Every dashboard, chart, table, figure or number shown here, or in any sample the site links to, is illustrative only: sample material prepared to show the shape of the firm's work. None of it comes from a client engagement, describes a client's business or foretells what any engagement will achieve.
- Conduct on the site
-
Use the site lawfully and without getting in the way of anyone else. Do not do any of the following.
- Interfere with the site, or with the machines serving it, or try to.
- Attempt to reach any area of the site, or any system or data, not deliberately opened to the public.
- Scan, probe or otherwise test the site, or any connected network, for weaknesses.
- Take the site or any substantial part of it by automated means, whether scraping, crawling for republication or bulk download.
- Send anything unlawful, defamatory, infringing or harmful through it.
- Ownership of content
-
Text, layout, logos, marks, images and design on this site belong to the firm or to licensors who allow the firm to use them, and copyright, trademark and related laws protect them. You may look at the site and keep printed or saved pages for reference within your own business. Reproduction, alteration, distribution, publication or derivative use beyond that needs the firm's written permission first. Ownership of work the firm produces for a client is fixed by that client's signed engagement and is untouched by this page.
- Other people's pages and services
-
The site links to the firm's main website and to a contact form there, and it fetches its typeface from an outside font service. Each is run under its own conditions and privacy practices, which apply when you use it. A link is offered for convenience; it endorses nothing and guarantees nothing about what lies beyond it.
- No promises about the site
-
The site and its contents come as they are and as they happen to be available. To whatever extent the law allows, the firm disclaims every warranty, whether express, implied or arising by statute, including accuracy, completeness, merchantability, suitability for any purpose, non-infringement and uninterrupted or fault-free operation. What appears here is general information about services. It is not professional, engineering, legal, financial or investment advice, and it should not be relied on as such without advice fitted to your circumstances.
- Limits on what the firm owes you
-
Within the limits the law allows, neither the firm nor its owners, staff, contractors or agents will be liable for indirect, incidental, special, consequential or punitive damages connected in any way with using this site or being unable to, whatever the legal theory and even if the possibility had been pointed out. The same goes for lost profit, lost revenue, lost business, lost data and lost opportunity. The firm's entire liability for every claim connected with the site, added together, cannot exceed one hundred US dollars in total. Should a jurisdiction refuse to enforce some part of this limit, the limit applies there only as far as that jurisdiction permits.
- What you owe the firm
-
If you misuse the site or break these conditions, you will compensate the firm and its owners, staff, contractors and agents for every resulting claim, loss, liability, damage and cost, reasonable attorneys' fees included, and hold them harmless from it.
- Law and forum
-
The State of New Jersey supplies the governing law for these conditions and for any dispute connected with them or with the site, leaving aside any rule that would apply another jurisdiction's law.
A dispute between you and the firm about these conditions or the site that informal discussion does not settle is settled by binding arbitration, before a single arbitrator. The American Arbitration Association administers it under that body's rules for commercial disputes, and the seat is Morris County, New Jersey. Any competent court may enter the arbitrator's award as a judgment. Both sides give up trial before a judge or jury and any class or representative proceeding. Where the law forbids arbitration of a particular dispute, that dispute goes instead to the state or federal courts sitting for Morris County, New Jersey, and you accept their jurisdiction.
- Housekeeping
-
- Invalid provisions. A provision held unenforceable is applied as far as it can be, and the remainder stands.
- Enforcement. Letting a breach pass does not surrender the firm's right to act on it later, or on any other.
- Whole understanding. Together with the privacy document, these conditions are the complete understanding between you and the firm about the site, superseding anything earlier. They leave every signed client engagement untouched.
- Amendment. The firm may change these conditions. The new text applies from the in-force date shown at the head of the page, and continued use after that date is acceptance of it.
- Reaching the firm
